Russian Ministry of Justice represented by Deputy Director of Department for Protection of National Interests from External Influence R.L. Tsyganov and official M.V. Pugachev submitted an formal reply to statement dated 05.10.2023. in the best traditions of Russian bureaucracy, evasion of compliance with the law and “fraud.”
The Ministry of Justice “turned on the fool” and presented an answer in the style of “I am not me and the cow is not mine.” General meaning of the answer is that we don’t know anything and we won’t take any measures.
As a result, the Ministry of Justice technically evaded fulfilling its direct responsibilities to comply with the law.
The behaviour of the Ministry of Justice employees can be compared with the miniature by the famous humourist Arkady Raikin, “Let’s Launch the Stupid Girl,” where the management of the enterprise, in order not to answer questions on the merits, responded to the request of higher authorities with the phrase “All the chickens are dead, send a new telescope.”
The following conclusions can be drawn from the answer.
1.) The conclusion based on the results of an independent anti-corruption examination is not subject to consideration due to the ban on conducting anti-corruption examinations by foreign agents.
2.) In terms of prosecution for falsification of evidence, the violation contains elements of a crime under Article 303 of the Criminal Code of the Russian Federation, the investigation of which is not within the competence of the ministry.
3.) It is proposed to appeal the court decision within the framework of the CAS RF.
I gave a reasoned answer and suggested taking appropriate measures.
Justice workers were given a legal education. Sometimes one gets the impression that officials of the main legal state body of the country are only ignoramuses. Ministry officials know how to “play fools.”
By doing this, they not only ignore the legitimate demands of civil activists but also produce arbitrariness and lawlessness, which, given the strategic importance of the Ministry of Justice in ensuring the functioning of the state legal system, simply threatens state security.
This can be compared to putting a person at the helm of an airplane who does not know how to fly it. This will definitely lead to a plane crash.
In this case, the Ministry of Justice employees are only “playing fools.” In fact, they know the laws very well and are aware of their actions.
Their goal is to suppress independent civil society at any cost.
If we continue the comparison with aviation, then employees of the Ministry of Justice, figuratively speaking, being at the helm of an airplane with an independent civil society on board, have long ago caused a deliberate plane crash. At the same time, they themselves were not injured; they jumped out with parachutes in time, having previously programmed the plane’s autopilot to crash.
After this, few people survived. Many public organizations ceased to exist. Many received “serious injuries” in the form of fines and administrative and criminal penalties. A number of civil activists left the country.
The Department for the Protection of National Interests from External Influence of the Russian Ministry of Justice, instead of protecting national interests, is engaged in the opposite matter – violation of these national interests, the priority of which is compliance with the constitution and laws of the country.
Therefore, another division needs to be created in the Russian Ministry of Justice – the Department for Protection from Violations of the Department for the Protection of National Interests from External Influence.
In the meantime, the department, which is ruled by punishers who are carrying out a purge of independent civil society and “pretending to be fools”, to whom the basics of jurisprudence supposedly need to be explained and their official duties explained, was asked to take the following measures.
Measure No. 1.
Based on articles 46, 194 CAS RF
The Ministry of Justice of the Russian Federation is invited to abandon the administrative claim against Stepan Petrov and terminate proceedings in case No. 5-1539/2023.
Measure No. 2.
Based on paragraph 168 of the Regulations of the Ministry of Justice of the Russian Federation, the regulations on the territorial body of the Ministry of Justice of Russia, articles 56, 59 of the Federal Law “On the State Civil Service of the Russian Federation”
The Ministry of Justice of the Russian Federation is invited to conduct an internal audit of officials of the Office of the Ministry of Justice of Russia in the Republic Sakha (Yakutia), who committed deliberate falsification of an administrative offense by submitting false information to the court, which was absent in the protocol on the administrative offense dated 01.08.2023, which resulted in what constitutes an illegal and unfounded court decision.
Measure No. 3.
Based on the message presented in the application, it is proposed to eliminate violations of anti-corruption legislation.
In case of failure to take measures provided for by law,
A petition will be sent to the Chairman of the Government of the Russian Federation to bring to justice the leadership of the Ministry of Justice of the Russian Federation, in particular with regard to:
-The Minister of Justice of the Russian Federation and the supervising Deputy Minister due to insufficient control over the activities of the structural divisions of the ministry;
-Director of the Department for the Protection of National Interests from External Influence, Deputy Director and employees of the department due to evasion of taking measures against employees of the regional departments of the ministry who committed violations of the law, resulting in significant violations of the rights of citizens, as well as from taking measures to eliminate violations of the law.
An Appeal will also be sent to the Prosecutor General’s Office of the Russian Federation to take measures of prosecutorial response to the fact of gross violation of laws and violation of official discipline by officials of the Ministry of Justice of the Russian Federation.
The scale and degree of suppression of Russian civil society in virtual wartime conditions have long reached its apogee, when not only the activities of independent non-governmental organizations are hampered, but their existence is simply threatened.
In the hands of Russian officials, there is a wide range of punitive instruments that would be the envy of any despotic regime.
The level of lawlessness of civil activists in Russia is at the level of the Middle Ages, when the Inquisition was carried out against those who disagreed with church tenets.
Modern heretics from Russian civil society are destined for a difficult fate.
They are persecuted only for disagreement with certain areas of government policy and any criticism of the regime, even constructive ones.
Russian government agencies identify targets of attack according to the principle “Whoever is not with us is against us.”
In their ignorance of the legitimate demands of civil activists, government bodies, including the Russian Ministry of Justice, themselves become lawbreakers and violate laws and the constitution.
Russian officials are unsurpassed masters of “fussing the brains”, capable of “turning the situation upside down” by 180 degrees.
In a situation where they are guilty, they are able to convince an innocent person of his alleged guilt and evade their responsibility, skillfully manipulating legal casuistry.
In these conditions of arbitrariness and lawlessness, citizens become powerless and many are visited by a feeling of hopelessness.
I, Stepan Petrov, as a civil activist, have been engaged in socially useful and nationally significant activities for many years.
I have the relevant experience, qualifications and certain merits.
I will not allow arbitrariness, lawlessness and injustice to be done towards myself.
I will resist this until the last opportunity.
In the course of my many years of public, anti-corruption, human rights and international activities, I often virtually single-handedly resisted the entire power of the state, law enforcement and judicial apparatus of Russia, which the Yakut corrupt officials turned against me.
What gives me strength is my conviction that I am right.
I have truth, justice, laws and international law on my side.
In turn, officials are guided not by the law and the constitution, but by the political situation and internal corporate guidelines.
Often this has nothing to do with the public good, but rather is directed against the people. Therefore, they are weak and will be held accountable for their violations.
So you can resist the state repressive apparatus alone, when truth, justice, laws and international law are on your side, which surpasses the imaginary superiority of the punitive authorities.
I will continue to resist arbitrariness, lawlessness and injustice.
To the best of my ability.
And I have immeasurable strength.
Stepan Petrov
